Welcome to www.thecourageousyes.com (“Site”), the official website of BF Wellbeing LLC (“Company”), owned and operated by Bethany Frankel.
These Terms & Conditions (“Agreement”) govern your access to and use of this Site. By using, browsing, or purchasing from this Site, you agree to be bound by this Agreement, as well as our Privacy Policy and Website Disclaimer.
If you do not agree, please discontinue use of the Site.
You must be 18 years of age or older to use this Site.
1. Permitted Use of the Site
This Site is intended to provide information about:
— 1-on-1 grief coaching services
— Online courses, programs, and digital resources
— Emotional wellness content, blog posts, and educational materials
— Coaching offers, events, and updates from BF Wellbeing LLC
You agree not to use this Site for any unlawful or prohibited purpose. Prohibited activities include:
— Posting or transmitting defamatory, harassing, or harmful content
— Submitting spam or unsolicited promotions
— Encouraging illegal activity
— Sharing copyrighted material without authorization
— Posting false, misleading, or fraudulent information
— Sharing another person’s private or confidential information
 
2. Coaching Services Terms
BF Wellbeing LLC offers grief coaching and emotional wellness support through 1-on-1 coaching sessions and group programs. The following terms apply to all coaching services:
— All coaching sessions are conducted virtually via Zoom unless otherwise agreed in writing
— A formal coaching relationship is only established after a written coaching agreement or service contract has been signed by both parties through HoneyBook
— Browsing this Site or purchasing a product does not create a coaching relationship
— Coaching services are provided by Bethany Frankel, a grief coach. 
Grief coaching is not therapy, psychotherapy, or clinical mental health treatment. It does not create a therapist-client or counselor-client relationship of any kind.
If you are experiencing a mental health emergency or crisis, please contact a licensed mental health professional or call 988 immediately.
 
3. Payment, Refunds & Cancellations
All payments for coaching services and digital products are processed securely through HoneyBook. By completing a purchase, you agree to the following:
Payments
— Payment is due at the time of booking or as outlined in your coaching agreement
— All prices are listed in U.S. dollars
— BF Wellbeing LLC reserves the right to update pricing at any time; changes will not affect existing agreements
Cancellations & Rescheduling
— You may reschedule a session with at least 24 hours’ notice at no charge
— Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee or forfeiture of the session
— No-shows without notice will be considered a forfeited session
Refunds
— Refunds for coaching packages are considered on a case-by-case basis and are at the sole discretion of BF Wellbeing LLC
— Sessions already completed are non-refundable
— Digital products and downloadable resources are non-refundable once accessed or downloaded
— If you have concerns about a purchase, please contact bethany@thecourageousyes.com within 7 days
 4. Coaching vs. Therapy — Scope of Practice
By using this Site and engaging with BF Wellbeing LLC, you acknowledge and agree to the following:
— Bethany Frankel is a grief coach, not a licensed therapist, psychologist, psychiatrist, or counselor
— Grief coaching is a supportive, forward-focused service and is not a substitute for licensed mental health treatment
— No clinical diagnosis, psychological assessment, or medical advice will be provided
— Coaching does not constitute the practice of medicine, psychology, or social work
— You are encouraged to seek support from a licensed professional if you are experiencing a mental health condition
Grief coaching is not a substitute for clinical mental health treatment. This coaching relationship is not appropriate for individuals who are experiencing active suicidal ideation, danger to self or others, unmanaged substance dependence, or conditions requiring clinical psychiatric care. If you are experiencing any of these, please seek support from a licensed mental health professional.
 
5. Confidentiality & Health & Safety Acknowledgment
BF Wellbeing LLC holds all coaching communications and personal information in strict confidence. By engaging with coaching services, you acknowledge:
— You are not currently experiencing active suicidal ideation, danger to self or others, unmanaged substance dependence, or conditions requiring clinical psychiatric care
— You understand that coaching is not emergency mental health support and is not a substitute for clinical treatment
— You will notify Bethany Frankel if your mental health needs exceed the scope of coaching so that appropriate referrals can be made
Confidentiality has limits. Information may be disclosed without consent in the following circumstances:
— There is imminent risk of harm to you or another person
— Disclosure is required by law or court order
— There is reasonable suspicion of abuse or neglect of a child, elder, or vulnerable adult 
6. Termination or Suspension
BF Wellbeing LLC may suspend, block, or terminate your access to the Site at any time and for any reason, at our sole discretion, without notice or liability. This includes termination for violation of these Terms.
 
7. Intellectual Property Rights
All content on this Site is owned or licensed by BF Wellbeing LLC, including:
— Logos, branding, and graphics
— Photos and images
— Written content, blog posts, and resources
— Course materials, programs, and digital products
— Website layout and custom design
This content is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without prior written permission from BF Wellbeing LLC.
 
8. User-Submitted Content
If you voluntarily send BF Wellbeing LLC any content such as comments, emails, messages, or testimonials, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content for business purposes, including marketing and social media, unless you explicitly request otherwise.
Please do not send confidential information you do not want shared.
 
9. Third-Party Links & Tools
This Site may contain links to or integrations with third-party platforms including:
— HoneyBook — client management, payments, and contracts
— Calendly — appointment scheduling
— Flodesk — email marketing
— Zoom — virtual coaching sessions
These platforms are outside our control. BF Wellbeing LLC makes no guarantees regarding their content, availability, or practices. Your use of any third-party platform is at your own risk and subject to their own terms and privacy policies.
 
10. Electronic Communications & Signatures
By using this Site, you consent to receiving electronic communications from BF Wellbeing LLC, including emails, invoices, contracts, and program updates.
You agree that any affirmation, assent, or agreement you transmit electronically — including clicking “I agree,” “I consent,” or signing via HoneyBook — constitutes a legally binding agreement equivalent to a written signature.
 
11. Limitation of Liability
To the fullest extent permitted by law, BF Wellbeing LLC is not liable for any damages resulting from your use of this Site or services, including but not limited to:
— Direct, indirect, or consequential damages
— Emotional, psychological, or relational outcomes
— Loss of profits or data
— Inaccuracies, omissions, or interruptions in services
— Issues related to device or platform compatibility
Some jurisdictions restrict the limitation of certain liabilities. Where prohibited by law, these limitations may not apply to you.
 
12. No Warranties
THIS SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that the Site will operate without errors or interruptions, that content is accurate or complete, or that any particular coaching outcome will be achieved.
 
13. Time Limitation on Claims
Any claim or cause of action relating to your use of this Site or services must be initiated within one (1) year of the date the claim arose. Claims not brought within this period are permanently waived.
 
14. Indemnification
You agree to indemnify and hold harmless BF Wellbeing LLC and Bethany Frankel from any claims, losses, damages, or expenses (including reasonable attorney’s fees) arising out of:
— Your use of the Site or coaching services
— Your violation of these Terms
— Your violation of any intellectual property, privacy, or other rights
 
15. Dispute Resolution
This Agreement is governed by the laws of the State of Florida, USA.
If a dispute arises, both parties agree to first attempt resolution through good-faith communication. If unresolved, both parties agree to pursue mediation before initiating any legal proceeding.
The prevailing party in any legal proceeding is entitled to recover reasonable attorney’s fees and costs.
 
16. Entire Agreement
This Agreement, together with the Privacy Policy and Website Disclaimer, constitutes the entire agreement between you and BF Wellbeing LLC regarding your use of this Site and supersedes any prior agreements.
 
17. Severability
If any part of this Agreement is found to be unenforceable, the remaining terms will continue in full force and effect.
 
18. No Waiver
Failure to enforce any provision of this Agreement does not waive BF Wellbeing LLC’s right to enforce it in the future.
 
19. Modifications to These Terms
BF Wellbeing LLC may update these Terms at any time. Updates become effective when posted to the Site. Your continued use of the Site following any update constitutes your acceptance of the revised Terms.
 
20. Assignment
Your rights under this Agreement cannot be transferred or assigned to any other person without prior written consent from BF Wellbeing LLC.
